What To Consider When Choosing A Child Custody Lawyer

Child custody cases are stressful enough. It’s crucial that you’re confident your family lawyer has you and your children’s best interests in mind. Here are a few things to consider when choosing a child custody lawyer:

Empathy

It’s important that you find a family lawyer who has experience handling child custody cases with compassion and empathy. We will take the time to understand your unique situation so that we can provide you and your family with guidance and support throughout the entire process.

Avoid Court

The goal of any separation should be to reach appropriate child custody arrangements based on your family's circumstances, while avoiding court. Our team of expert child custody lawyers are skilled negotiators who will always pursue a collaborative solution over a court settlement, saving you time, money and stress by avoiding court.

Straightforward Advice

Your family lawyer should help you understand the process and what’s required to achieve a fair outcome for both parties. At Nolan Lawyers, we’re transparent about the likely outcome for your situation, so you know exactly where you stand and the action you need to take.

Accessibility

Your child custody lawyer should be available when you need to speak to them, and since there’s a lot of admin involved, it’s easier if your lawyer is close by. We always make sure we respond to any questions within a reasonable time frame and we are conveniently located in the heart of the Sydney CBD.

What To Expect From The Child Custody Process

Coming to a mutual parenting agreement – either by yourselves, through mediation, or with the help of an experienced family lawyer – is always the best option for you and your children.

That’s because you avoid lengthy, expensive court proceedings, which can cause unnecessary stress for everyone involved.

We will guide you through each step of the child custody process, which involves:

  • We will take the time to understand your family’s unique situation and concerns.
  • If you don’t fully understand your parental and legal rights, we will explain these to you in simple language.
  • Next, you’ll discuss your options, and we will prepare a detailed plan outlining the next steps, estimated time frames, and costs.
  • The first step is to attend mediation with a suitably qualified Family Dispute Resolution (FDR) practitioner or Mediator.
  • If mediation is unsuccessful, we will give you a Section 60i certificate. You need this certificate in order to make an application to the Court seeking parenting orders where there is no agreement between you and the other parent.
  • If mediation is successful, we can help you formalise any agreement reached at mediation in a Parenting Plan or Family Court Consent Orders.
  • An alternative option to mediation is to have us try to negotiate suitable parenting arrangements directly with the other party’s lawyer. If agreement is reached, we can assist you in recording the agreement in a Parenting Plan or Family Court Consent Orders.
  • If agreement cannot be reached through mediation or through negotiations between your family lawyers, you may have to consider making a court application for parenting orders.

A Parenting Plan or Consent Orders will document the parenting agreement, which covers specific details unique to your family, including the live with and spend time arrangements as well as other circumstances, like holidays, special occasions and overseas travel.
